In compliance with the provisions of Article 27 of Act 34/2002 on Information Society Services and Electronic Commerce, you are informed that once your user account has been created the contracting procedure will be handled by the company FINETRADE, with whom the service provider has reached an exclusive commercial agreement as the online sales channel for the products that it markets, and will follow these steps:

If the product that you wish to purchase is a bike, you must collect it from an Orbea store. If it is not a bike, you can have it delivered to whatever address you wish. In the latter case the service provider assumes no liability for any failure to deliver the product as a result of you, the user, providing false, inaccurate or incomplete data or when the delivery cannot be made for reasons not attributable to the shipping company.
The service provider has taken all the measures required of a diligent retailer to ensure that the product is delivered at the agreed time and, if this is not possible, as soon as possible, and therefore accepts no liability in this regard.
You can check the estimated delivery date under ORDERS in MY ACCOUNT. The estimated delivery time will be less than 30 days. In the event of delivery taking longer, the service provider will inform you of the new delivery date.
We will inform you of any delay in the delivery of your order. However, to the extent permitted by law, we accept no liability for any losses, costs, damages or charges associated with said delay.
All orders are subject to item availability. If any incidents occur in the supply or if the product is unavailable, you will be informed as soon as possible, and may then change or cancel your order.
The prices indicated for each product include the corresponding Value Added Tax (VAT) and are always shown in Euros (€). Unless expressly indicated otherwise, the price of the product does not include shipping costs. Shipping costs will be added in the purchase summary, before payment is made.
The prices shown on this website do not include customs fees, taxes or duties. The orders placed may be subject to customs duties and/or taxes and import charges, depending on the buyer's country and the destination of the merchandise requested by the user; these will be payable once the shipment reaches the country of destination. Users hold sole liability for any additional fees associated with customs clearance; the service provider has no control over such charges; nor can it predict them or how much they will be.
The prices applicable to each product will be those posted on the website. They will be automatically applied during the final phase of the contracting process. The service provider reserves the right to modify the prices shown on the present website without prior notice. In the case of any error in the price applied, we will notify you as soon as possible and you will have the option to confirm your order at the correct price or to cancel it. If we are not able to notify you of this error, the order will be considered canceled and you will receive a full refund for the amounts paid. All payments made will entail the issuance of an invoice in the name of the registered user.

Cancellation of Orders
You have the right to cancel one or more items included in your order up to the time when it is shipped. Select the items that you wish to cancel by checking the Cancel Item box and then clicking on OK to confirm cancellation. Once you have completed the cancellation process, we will refund the price within 4.7 days via the same method used to make payment.
Terms & conditions for returns
Terms & conditions for returns vary depending on whether you collected your products from an Orbea store or had it delivered to your home.
For all returns, you will need a claim number associated with the order. To obtain that number please contact Customer Service for online sales by e-mail at email@example.com or by telephone on ++34 902 042 929.
You may return the product within 15 calendar days as from the date when the item was delivered to you at the store. The product returned must be in the same condition as when it was delivered to you, unused and with its original packaging and labels. Customized orders may not be returned.
To return a product, hand it over to the distributor from whom you collected it. Once the store has checked that the product is in the required condition, you can request a refund via the website.

Once the product arrives back at Orbea and we confirm its condition the price of the items returned will be refunded in 4-7 days, minus the shipping costs entailed by the sending of the original order.
If you observe any knocks or damage on the packaging when you receive your order, make a note of them on the delivery note provided by the shipping company (e.g. “packaging damaged”) and return the package unopened to the carrier. Products can only be returned in exchange for a refund. If you need a different size or color, or wish to acquire alternative products, you must place a new order.
For some models, Orbea offers you the possibility of selecting bicycle components so that you can customize your bike according to your needs and tastes.
The exclusive customization of such bicycles means that we cannot accept returns except in case of manufacturing defects.

These general terms and conditions of sale (the “General Terms & Conditions”) govern the sale by FINE TRADE Gmbh, with corporate headquarters at Am Garnmarkt 4, 6840 Götzis (Austria) and UID ATU 66342157 (“FINE TRADE”) to customers (the “Customer”) of the products (the "Products") offered by FINE TRADE and supplied to the latter by ORBEA DISTRIBUCION ONLINE; S.L. via channels owned by Orbea S. Coop. (hereinafter called "ORBEA") as envisaged in the product catalogue provided by ORBEA via its website.
1.2. For the purposes covered by these General Terms & Conditions, the Products are aimed solely at the Customer or purchaser, a natural or legal person who acts as the end user or recipient, so any subsequent resale trading or distribution of the products is prohibited.
1.3. These General Terms & Conditions apply to all purchases from FINE TRADE of products offered by ORBEA DISTRIBUCION ONLINE, S.L., as the sole distributor of ORBEA Products via online sales channels, formalized by the Customer via the website http://orbea.com/ (the “Online Store"). The Customer asserts that he/she/it is legally capable of making binding agreements and acquiring the Products, and agrees to be bound by these General Terms & Conditions. The Products may be purchased only by natural persons aged eighteen (18) and over resident in the European Union and legal persons resident in the European Union.
2.1. Customers may place orders from their website by filling in the forms provided for that purpose. Once the sale process is completed the Customer will be sent a confirmation of purchase, which will include the full terms and conditions applicable to the purchase of the Product. The purchase agreement will then be considered as formalized, entailing full acceptance by the purchaser of the terms of sale offered by FINE TRADE via the channels set up by ORBEA, and of the applicable terms and conditions as relevant.
2.2. On making the purchase the Customer undertakes to pay for the product via the form of payment selected.
2.3. All purchases are subject to checks on product availability and Customer solvency as envisaged in these General Terms & Conditions. FINE TRADE may reject orders if the product is not available or the Customer is determined not to be solvent.
3.1. The Product supplied by FINE TRADE will match the description and specifications appearing in the ORBEA catalogue available to the Customer at the time when the order is placed. The product catalogue includes a data file on each Product comprising a brief description, the price (including tax), the estimated delivery time and guideline information on Product availability.
3.2. If the Product requested is not available at the time when the order is processed, FINE TRADE will inform the purchaser accordingly and will refund the price thereof. Alternatively, the Customer may be informed of when the Product is expected to become available and how long shipping may be expected to take thereafter. The website may feature Products that are not available immediately. However, such products can be purchased and will be shipped as soon as they become available at the warehouse.
4.1. The price charged for the Product will be that in force at the time when the order is formalized. The price offered to the Customer is the final price including all taxes applicable by law and any other charges applicable as per the product data file at the time of the order.
4.2. Shipping costs must be paid along with the Product price. Shipping costs will be itemized when the order is placed and added to the total amount payable for the Products selected.
4.3. The specifications and prices shown may occasionally be affected by human or computer errors. On such occasions FINE TRADE will detect the pricing error during the order checking process. If the correct price of the Product is higher than that shown in the store, FINE TRADE will advise the Customer of the difference so that the latter can choose between continuing at the correct price or cancelling the order. If the correct price is lower than shown, the lower price will be charged and the Product will be shipped.
4.4. The Customer may select any of the forms of payment available to pay FINE TRADE for Products. On authorizing payment, the Customer confirms that he/she/it is the lawful holder of the payment method used.
4.5. Credit and debit cards are subject to checks and authorizations by the card issuer. Should the card issuer not authorize payment, the order cannot be completed.
4.6. Should the payment method chosen be direct debit from a bank account, the Customer expressly agrees to the amount being charged to his/her/its account by FINE TRADE.
4.7. In cases when amounts are not charged directly at the time of the order (payment by bank transfer) the Customer has up to fourteen (14) days in which to make payment. Should payment not have been made by the end of that time FINE TRADE, without prejudice to the provisions of subsection 4.11 below, reserves the right to cancel the order and refund any amount already paid at that time. FINE TRADE also reserves the right to reject further orders until the order pending payment has been fully processed. The provisions of this subsection will not apply to payments by instalments, for which the payment deadline will be set in the specific terms and conditions governing such payments.
4.8. Ownership of the Product remains with FINE TRADE until the Customer has paid the price in full.
4.9. FINE TRADE will send a detailed invoice to the Customer, who must keep same in case of exchange or return and for warranty provisions as proof of the date of purchase, model and Product purchased from FINE TRADE.
4.10. FINE TRADE will issue an invoice for the purchase made. If payment is made by instalments, FINE TRADE will issue a single invoice.
4.11. FINE TRADE may charge the amount of five Euros (€5) as a surcharge if payment of the Product is delayed by more than seventy-two (72) hours. Should payment still not have been made after seven (7) days, FINE TRADE may apply a further surcharge of ten Euros (€10) for the same reason. Notwithstanding the foregoing, FINE TRADE reserves the right to terminate the agreement.
4.12. FINE TRADE reserves the right to cancel the transaction for security reasons if any anomaly or suspicion of fraud is detected.
5.1. In payments by instalments the Customer undertakes to make payments on the dates and in the amounts agreed, including the relevant administrative fees, as per the information provided in advance by FINE TRADE, and may not dispose of the Product (by sale, change of ownership or otherwise) until its price has been paid in full.
5.2. FINE TRADE reserves the rights of ownership of the Product until the Customer has paid its price in full.
5.3. Further to the provisions of this clause, all the provisions concerning payment by instalments in these General Terms & Conditions will apply.
6.1. Products purchased will be delivered either to an authorized ORBEA distributor or by a private carrier to the address indicated by the Customer on placing the order, depending on the type of Product purchased. Should the Customer subsequently change the point of delivery, any additional costs incurred over and above the selling price will be payable by the Customer. The Product will be delivered to the Customer, who must sign the delivery note. The Product will be delivered properly packaged and sealed in all cases. Bicycles will always be delivered to the authorized ORBEA distributor selected by the Customer during the purchase process, properly assembled, adjusted and in working order. Should the Customer not be satisfied with the items delivered or with their condition, he/she/it must sign for them in proof of receipt but should add a hand-written comment to the delivery note provided by the carrier or the store indicating the defects observed on receipt, and should then e-mail email@example.com within 24 hours to report the defects detected.
6.2. The Customer recognizes that the delivery and pickup times given our estimates and that there may be delays in shipment that do not depend on FINE TRADE or ORBEA. If the Customer cannot be located or is not found at the designated address after two (2) attempts at delivery or collection handled by ORBEA, the Customer will be understood to have cancelled the order, in which case the amounts paid for the Product will be refunded. In such cases FINE TRADE reserves the right to deduct from the refund to the User the amounts paid for administrative fees and shipping of the Product.
6.3. The risk of loss of or damage to the Product is transferred to the Customer at the time of delivery of the Product.
7.1. FINE TRADE offers a warranty of two (2) years on the Product as from the date of delivery of same, without prejudice to the legal and/or commercial warranty offered by the manufacturer under the warranty policy in force at the relevant time, which the User may consult at the orbea.com website.
7.2. The warranty period of two (2) years will be suspended in case of any repairs. The suspension period will commence when the purchaser places the Product at the disposal of FINE TRADE and will end when the repaired Product is delivered. If the Product still fails to conform to the sales agreement after it has been repaired and delivered, the Customer may demand a replacement, unless this option is judged to be impossible or disproportionate or the problem results from circumstances beyond the reasonable control of FINE TRADE (force majeure), in which case the latter may offer alternatives such as a reduction in price or the termination of the agreement.
7.3. FINE TRADE will replace the Product when:
a) The Customer advises FINE TRADE in writing of the existence of the defect within two (2) months as from its appearance.
b) It can be accredited that the defect in question is due exclusively to manufacturing or storage defects and not to improper use of the Product.
c) The Product is handed over to FINE TRADE should FINE TRADE so require.
The warranty period of two (2) years is suspended as from the time when the Customer exercises this option up to the delivery of the new Product.
8.1. FINE TRADE may not be held liable for any nonfulfillment or delay in fulfilment of any obligation envisaged in these General Terms and Conditions which is due to events beyond its reasonable control (force majeure).
8.2. The duties of FINE TRADE resulting from this agreement will be deemed to be suspended for so long as the force majeure persists, and an extension of the period for the fulfilment of the said duties equal in length to the duration of the force majeure circumstances will be given. FINE TRADE will apply all reasonable diligence and means to strive to meet its obligations in spite of the force majeure circumstances.
9.1. FINE TRADE acknowledges the right of withdrawal of the Customer, who may return the Product within fifteen (15) calendar days as from the date on which it is actually received.
9.2. The right of withdrawal may be exercised via the following channels:
By e-mailing ORBEA at the following address: firstname.lastname@example.org, from which support is provided to FINE TRADE in handling the right of withdrawal.
9.3. The refund will comprise the full amount of the purchase minus delivery costs. The refund will be made via the same means of payment used to acquire the Product. FINE TRADE informs you that direct costs entailed by the return will be payable by the Customer.
9.4. The Customer must return the Products for which the right of withdrawal is exercised without undue delay, and within no more than fifteen (15) calendar days as from the date on which the decision to exercise that right is reported to FINE TRADE. The amount refundable under the withdrawal must be refunded within fifteen (15) calendar days as from the date on which the decision to withdraw from the agreement is effectively and unequivocally reported, provided that FINE TRADE has already received the Product. Otherwise, the refund may be held back until the Product is received or until the Customer can provide proof that it has been returned. In the case of bicycles and other Products collected from authorized distributors of ORBEA, product returns must be handled by and products must be returned to those authorized distributors.
9.5. The Customer is liable for any reduction in the value of the Product that results from any handling of same other than that strictly necessary to establish its nature and characteristics and confirm that it is in working order.
9.6. In all cases, for the right of withdrawal to be effectively exercised the Product must be returned in its original packaging, along with the invoice and all its components. Before returning the Product, the Customer must ensure that it is properly protected and sealed to prevent any damage in transit.
10.1. In accordance with personal data protection regulations, we hereby inform you that the data that you voluntarily provide during the process of purchasing a Product from FINE TRADE will be added to an automated file duly registered under the control of FINE TRADE, for the purpose of being able to identify you, carry out all the procedures necessary to complete the purchasing process for the selected Product and inform you, by any means, including email, about offers for products and services offered by FINE TRADE and other areas of activity such as telecommunications, insurance, finances, foodstuffs and travel. We further inform you that we may access automated files on solvency, assets and creditworthiness to assess your solvency and make such checks as may be relevant to assess risks and the potential for fraud at the pre-contractual and contractual stages. Should you fail to meet your payment obligations on time, FINE TRADE may report your identification details and full data on the outstanding debt to providers of information services on solvency, assets and creditworthiness, in line with current legislation by completing the corresponding forms, Customers authorize the processing of their data for the purposes specified.
10.2. Under This Agreement, and for the purposes indicated above, the Customer expressly authorizes FINE TRADE to report his/her/its details to organizations such as transport and logistics operators and to members of its corporate group whose intervention is necessary to complete the process of purchasing the Product.
Customers may exercise their rights of access, rectification, deletion and objection in regard to their data by sending a written request along with a copy of their identity card or any other document serving the same purpose, to the headquarters of FINE TRADE at Am Garnmarkt 4, 6840 Götzis (Austria), or by e-mailing the company at the following address: email@example.com
11.1. Each Party hereto acts in its own name and by its own right.
11.2. Neither Party may assign the rights, interests, duties or liabilities that it acquires by accepting these General terms and Conditions or delegate any such liability without the prior consent in writing of the other Party.
11.3. Should the wording of any clause of these General Terms and Conditions be considered non-valid, unlawful or unenforceable for any reason, the validity of the rest of the clauses will remain unaffected.
11.4. To be valid, any amendment of or modification to these General Terms and Conditions must be accepted in writing by FINE TRADE
11.5. FINE TRADE may modify the General Terms and Conditions at any time. Such modifications will in no case affect purchases already made. FINE TRADE will advise of any modifications to its General Terms and Conditions one (1) month prior to the entry into force of the new wording.
12.1. These General Terms and Conditions are governed by Spanish law.
12.2. In general, any litigation arising from this agreement will be heard by the courts and tribunals of Bilbao. If the Customer is classed as a consumer, litigation will be heard by the courts and tribunals deemed competent under the consumer regulations in force at the relevant time.
