Purchasing process

If your order includes a bike and you want it delivered to your home, you must select a distributor that you trust and which can provide any adjustment required, check your bike free of charge and deal with any warranty claims as necessary.

If the product that you wish to purchase is a bike, you must collect it from an Orbea store. If it is not a bike, you can have it delivered to whatever address you wish. In the latter case the service provider assumes no liability for any failure to deliver the product as a result of you, the user, providing false, inaccurate or incomplete data or when the delivery cannot be made for reasons not attributable to the shipping company.
The service provider accepts no liability should a product not be delivered because the data provided by the User proves to be false, inaccurate or incomplete or because of reasons not attributable to the shipping company.
The service provider has taken all the measures required of a diligent retailer (DHL and Fedex) to ensure that the product is delivered at the agreed time and, if this is not possible, as soon as possible, and therefore accepts no liability in this regard.

Terms & conditions for returns vary depending on whether you collected your products from an Orbea store or had it delivered to your home.

1.4 You shall send back the products to Polígono Industrial Goitondo s/n 48269, Mallabia (Bizkaia). Spain or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you have communicated your decision to withdraw from the contract to us in accordance with clause 5.2. The deadline is met if you send back the products before the period of 14 days has expired. In consideration of risk of loss or damage of products as implied under clause 6.6, we recommend that you use a carrier that allows tracking and monitoring of delivery status for your returns. For most efficient processing of your return we suggest that you contact us at the telephone number indicated to obtain a return merchandize authorization (RMA) number prior to returning your product.
1.5 You shall only bear the direct cost of returning the products. You are only liable for any diminished value of the products resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the products.
1.6 if you want the performance of services to begin during the withdrawal period provided for in clause [5.1(a)] we require that you make an express request. You acknowledge that you will lose your right of withdrawal once the service has been fully performed. If you exercise the right of withdrawal after having made such request, but before the service has been fully performed, you shall be liable to pay us reasonable costs, consisting of an amount which is in proportion to what has been provided until the time you have informed us of the exercise of the right of withdrawal, in comparison with the full coverage of the contract. The proportionate amount to be paid by you to us shall be calculated on the basis of the total price agreed in the contract. If the total price is excessive, the proportionate amount shall be calculated on the basis of the market value of what has been provided.

In general, any litigation arising from this agreement will be heard by the courts and tribunals of Bilbao. If the Customer is classed as a consumer, litigation will be heard by the courts and tribunals deemed competent under the consumer regulations in force at the relevant time.
If the Customer is classed as a consumer and considering that MODUSLINK B.V. is the company selling and therefore billing any product article purchased in orbea.com under the agreement reached, these General Terms and Conditions and therefore it’s purchases are governed by the laws of Czech Republic without regard to conflict of laws principles. You submit to the exclusive jurisdiction of the courts of Czech Republic. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
